Tuesday, 29 August 2017 By executive order issued under “the authority vested in [him] by the Constitution,” Donald Trump restored the federal program whereby local and state law enforcement can apply to receive surplus military equipment from the U.S. Department of Defense.
The pipeline of materiel from Pentagon to police precinct is known as Department of Defense Program 1033, and it has been a fruitful bough from which local law enforcement has eaten eagerly. Robots, facial recognition, and drones: These are the technologically advanced tools that used to belong to the military, but are now commonplace in local police departments thanks to grants authorized decades ago by the Defense Department’s 1033 program and now reauthorized by President Trump’s latest executive order. Is a Militarized Police The Answer To Inner City Turmoil? President Trump announced that he would be removing the restrictions placed by President Obama on transferring military equipment to civilian police departments. Is this being "tough on crime," as he likes to claim, or is it all about controlling the population and undermining civil liberties?
(Article Continued) The current president had to use his pen to power up the program after the previous president used his to curtail it after the protests following the events in Ferguson, Missouri, in 2015. Why did President Trump find it necessary to open what President Obama had closed? There was no official declaration from the White House, unless one counts the title of the executive order: “Presidential Executive Order on Restoring State, Tribal, and Local Law Enforcement's Access to Life-Saving Equipment and Resources.” A local Nashville television station, however, reported a partial transcript of Attorney General Sessions’ remarks, and they cast further light on the likely reasons for the restoration: Helping law enforcement do their jobs, helping the police get better, and celebrating the noble, honorable, essential and challenging work of our law enforcement communities will always be a top priority of President Trump and this Department of Justice. We will always seek to affirm the critical role of police officers in our society and we will not participate in anything that would give comfort to radicals who promote agendas that preach hostility rather than respect for police. President Trump is serious about this mission. He is doing all he can to restore law and order and support our police across America. And that is why, today, I am here to announce that President Trump is issuing an executive order that will make it easier to protect yourselves and your communities. He is rescinding restrictions from the prior administration that limited your agencies' ability to get equipment through federal programs, including life saving gear like Kevlar vests and helmets and first responder and rescue equipment like what they’re using in Texas right now. Some of these programs, like the Department of Defense's 1033 program that Congress signed into law more than 25 years ago, have recycled more than $5.4 billion in used gear and equipment that taxpayers had already purchased, and made it available for your agencies to repurpose it in the fight against terrorism, crime, and disaster relief. Equipment like helicopters and armored vehicles are also vitally important to emergency and disaster response efforts. One sheriff told me earlier this year about how, due to the prior administration's restrictions, the federal government made his department return an armored vehicle that can change the dynamics of an active shooter situation. These are the types of helmets and gear that stopped a bullet and saved the life of an officer during the Orlando nightclub shooting. This is the type of equipment officers needed when they pursued and ultimately killed terrorists in San Bernardino. Studies have shown this equipment reduces crime rates, reduces the number of assaults against police officers, and reduces the number of complaints against police officers. Those restrictions went too far. We will not put superficial concerns above public safety. All you need to do is turn on a TV right now to see that for Houstonians this isn’t about appearances, its about getting the job done and getting everyone to safety. There it is in the words of the attorney general. The reasons local law enforcement needs leftover military war fighting equipment is to keep you safe. Safety. The arguably oldest exchange ever conducted between the governed and the governors: The latter promise safety if the former will purchase it with liberty. One federal lawmaker mentioned that dangerous and often deadly deal (liberty for safety) in a statement issued just minutes after AG Sessions revealed the restoration of the 1033 program. In a press release announcing legislation aimed in limiting the scope of the Pentagon-to-police distribution deal, Senator Rand Paul (R-Ky.) said: Americans must never sacrifice their liberty for an illusive and dangerous —or false — security. I disagree with Attorney General Sessions on the Department of Defense’s 1033 program. The militarization of our law enforcement is due to an unprecedented expansion of government power in this realm. It is one thing for federal officials to work with local authorities to reduce or solve crime, but it is another for them to subsidize militarization. I will oppose this move by the Attorney General and the administration, and I will continue to fight for civil liberties and criminal justice reform, which will all be major issues this fall. Defense Department grants of military materiel to police departments are the opposite of the movement sponsored for decades now by The John Birch Society to “Support Your Local Police.” Police who receive vehicles, surveillance equipment, weapons, training, and tear gas from the Pentagon are hardly local, and when there is a conflict of interest between those being served (the community) and those providing the powerful weapons, the people are all too likely to be ignored in favor of the givers of the free stuff: the federal government. Jim Fitzgerald worked for eight years as a vice and narcotics squad detective in Newark, New Jersey, before joining the staff of The John Birch Society, and he is currently the point man for the organization’s “Support Your Local Police” initiative. In an interview with The New American conducted in 2014, Fitzgerald said of the military-grade equipment being bought by local law enforcement with DHS grant money, “The only reason to have this equipment is to use it,” and it is likely it would be used against local citizens who have risen up and created some sort of civil disorder. Paradoxically, the police’s push to be prepared and trained to quell civil unrest is fomenting the feelings that could create such an uprising. Americans are tired of reading reports of law enforcement behaving less like the police and more like the gestapo, less like servants of the law and more like servants of the state, deployed with the training, technology, tactics, and weapons capable of enforcing the increasingly unconstitutional edicts of the ruling regime. On January 20, 2017, Donald J. Trump placed his hand on a Bible and swore to "preserve, protect, and defend the Constitution of the United States." Where in that document is the president granted — as he claims he is in the first sentence of his executive order — the power to, as Sessions worded it, "restore law and order and support police across America"?

“Significant ethnic differences in a community can create an atmosphere of distrust, even hatred…… (and) can cause an eruption of civil disorder that can lead to full riots,” states the document.
Although the document makes reference to the Constitutional rights of American citizens it goes on to stress that such protections are null and void under a state of emergency, asserting that Posse Comitatus, which is supposed to limit the power of the federal government to use military personnel domestically, “does not apply” under declared “emergency authority” or “When the need for the protection of federal property or federal functions exists.”
It is important to stress that this training manual applies to U.S. Army operations in foreign countries as well as domestically on U.S. soil. Indeed, section 2-18 of the document goes into detail about domestic protests such as the 1999 anti-WTO demonstration in Seattle.
The emergence of the document as National Guard troops prepare to descend on Ferguson, Missouri to deal with looting and civil unrest follows a report we published just a few weeks before the outbreak of the Ferguson riots which documented how National Guard troops were training to detain unruly African-American citizens in prison camps before handing them over to police.
In a special video report, Alex Jones documented how the story was part of wider preparations by the government for domestic disorder that have been ongoing for years.
We have reported previously on similar documents that outline how the U.S. Army would be forced to resort to lethal measures in order to deal with unruly Americans during times of emergency within the United States.
In 2012 we covered FM 3-39.40 Internment and Resettlement Operations, a U.S. Army manual that describes how political activists in prison camps will be indoctrinated by specially assigned psychological operations officers. The document makes numerous references to how government agencies like the DHS, ICE and FEMA will be involved in the domestic internment of U.S. citizens during “civil support operations.”
A second US Army Military Police manual that was leaked months later also outlined how military assets would be used domestically to quell riots, confiscate firearms and even kill Americans on U.S. soil during mass civil unrest.
U.S. troops and National Guard also worked with local police to incarcerate Americans in detention camps during drills Alex Jones covered in 1999 in Oakland, California.
A report produced in 2008 by the U.S. Army War College’s Strategic Institute warned that the United States may experience massive civil unrest in the wake of a series of crises which it termed “strategic shock.”
“Widespread civil violence inside the United States would force the defense establishment to reorient priorities in extremis to defend basic domestic order and human security,” stated the report, authored by [Ret.] Lt. Col. Nathan Freir, adding that the military may be needed to quell “purposeful domestic resistance”.
Rex 84, short for Readiness Exercise 1984, was established under the pretext of a “mass exodus” of illegal aliens crossing the Mexican/US border.
During the Iran-Contra hearings in 1987, however, it was revealed that the program was a secretive “scenario and drill” developed by the federal government to suspend the Constitution, declare martial law, assign military commanders to take over state and local governments, and detain large numbers of American citizens determined by the government to be “national security threats.”

ASSASSINATION PROGRAM
My topic for this evening is “now, it’s assassinations”. What have we allowed ourselves to become? Are we no longer a nation of laws? Have we become instead a nation of men who make secret arrests? Are secret prisons now simply another tool of the federal government law enforcement? Is secret rendition of individuals now permitted out of misplaced fear? Have we decided that the writ of habeas corpus is not worth defending? Is torture now an acceptable tool for making us safe?
Unfortunately, the single answer to all these questions from the leaders of our country to many of our citizens appears to be yes. And now we are told that assassination of foreigners as well as American citizens is legitimate and necessary to provide security for our people. It is my firm opinion that nothing could be further from the truth.
Secret arrests, secret renditions, torture and assassinations are illegal under both domestic and international law. These activities should be anathema to the citizens of a constitutional republic. The real threat doesn’t arise from our failure to torture, rather desensitizing our nation to the willful neglect and sacrifice of our civil liberties fought and died for over the centuries, is the threat.

In response to federal overreach, most people tend to focus on three types of actions to stop them: elections, conventions, and lawsuits. While they all have their place in an overall strategy to defend the Constitution, none of them should be the first step forward. That is, if you follow the advice of the “Father of the Constitution.”
Here’s what James Madison had to say in Federalist #46. The Influence of the State and Federal Governments Compared:
“Should an unwarrantable measure of the federal government be unpopular in particular States, which would seldom fail to be the case, or even a warrantable measure be so, which may sometimes be the case, the means of opposition to it are powerful and at hand. The disquietude of the people; their repugnance and, perhaps refusal to cooperate with officers of the Union, the frowns of the executive magistracy of the State; the embarrassment created by legislative devices, which would often be added on such occasions, would oppose, in any State, very serious impediments; and were the sentiments of several adjoining States happen to be in Union, would present obstructions which the federal government would hardly be willing to encounter.”
Let me translate. Madison said that when the federal government passes an unconstitutional measure there are powerful methods to oppose it – amongst the people and in the states. He also pointed out that those methods were available even for warrantable, that is constitutional, measures.
Madison told us of four things that should be done to resist federal powers, whether merely unpopular, or unconstitutional.
1. Disquietude of the people – Madison expected the people would throw a fit when the feds usurped power – even using the word “repugnance” to describe their displeasure. That leads to the next step.
2. Repugnance and Refusal to co-operate with the officers of the Union – Noncompliance. The #1 dictionary of the time defined repugnance as “disobedient; not obsequious” (compliant). If you want to stop the federal government, you have to disobey them. Madison also suggested that people would perhaps directly refuse to cooperate with federal agents. This is an approach we preach here every day at the Tenth Amendment Center. James Madison apparently knew what we know today. The feds rely on cooperation from state and local governments, as well as individuals. When enough people refuse to comply, they simply can’t enforce their so-called laws.
3, The frowns of the executive magistracy of the State – Here Madison envisions governors formally protesting federal actions. This not only raises public awareness; executive leadership will also lead to the next step – legislative action.
4. Legislative devices, which would often be added on such occasions – Madison keeps this open-ended, and in the years soon after, which I’ll cover shortly, we learn how both he and Thomas Jefferson applied this step.
Madison also told us that if several adjoining States would do the same it would be an effective tool to stop federal acts. To repeat, he said that doing this “would present obstructions which the federal government would hardly be willing to encounter.”
Judge Andrew Napolitano agreed recently and said that people need to stop enforcing unconstitutional federal laws. He also said that if you could get an entire state doing this, it would make federal laws “nearly impossible to enforce.”
What’s important to note here, are some glaring omissions. The powerful means that Madison told us would be used to oppose federal power successfully did NOT include federal lawsuits in federal courts. He also did NOT include “voting the bums out” as a strategy, either.
FIRST RESPONSE
Compare that with how people generally respond to what they consider unconstitutional or unpopular federal acts today.
The first thing I tend to hear from people who are opposed to a federal act is the “vote the bums out” mantra. We’ll fire congress, right?
Or some people tell us we have to sue and let the courts decide.
I’ve got some news for you. There’s nothing from the founders – anywhere – in which they tell us that our first response to extreme, repeated violations of the constitution and liberty is to vote the bums out, or sue the feds in federal court. Nothing.
LEGISLATIVE DEVICES
Thomas Jefferson followed up on this in 1798 with the same kind of advice. That year, the Adams administration passed a wildly unconstitutional attack on the freedom of speech with the Alien and Sedition Acts. In response, while sitting as vice-president, Jefferson secretly drafted the Kentucky Resolutions, and here’s a little of what he wrote:
“The several states composing the united states of america are not united on a principle of unlimited submission to their general government.”
“where powers are assumed which have not been delegated, a nullification of the act is the rightful remedy”
“that every State has a natural right in cases not within the compact to nullify of their own authority all assumptions of power by others within their limits: that without this right, they would be under the dominion, absolute and unlimited, of whosoever might exercise this right of judgment for them”
Madison was consistent in his views on this. In 1798, he also drafted and help pass something known as the Virginia Resolutions, a state-level “legislative device” in response to the Alien and Sedition Acts. Here’s a key part:
in case of a deliberate, palpable, and dangerous exercise of other powers, not granted by the said compact, the states who are parties thereto, have the right, and are in duty bound, to interpose for arresting the progress of the evil, and for maintaining within their respective limits, the authorities, rights and liberties appertaining to them.
Like Madison advised in Federalist #46, both he and Thomas Jefferson advised a state-level response to dangerous federal acts. In 1798, neither of them even mentioned voting or lawsuits.
Jefferson told us that a “nullification is the rightful remedy.” And Madison told us that states are “duty-bound to interpose.”
When Daniel Webster called on these same principles in response to military conscription plans during the war of 1812, he said:
“The operation of measures thus unconstitutional and illegal ought to be prevented by a resort to other measures which are both constitutional and legal. It will be the solemn duty of the State governments to protect their own authority over their own militia, and to interpose between their citizens and arbitrary power. These are among the objects for which the State governments exist; and their highest obligations bind them to the preservation of their own rights and the liberties of their people”

The Department of Defense transferred over $4.3 billion worth of surplus military equipment--including 345 Mine Resistant Ambush Protected vehicles (MRAPs), 205 grenade launchers and over 12,000 bayonets--to more than 17,000 state and local law enforcement agencies across the nation since 1997.
The transfers were made under the 1033 program of the National Defense Authorization Act and
administered by the Defense Logistics Agency (DLA),
according to a report by
the American Civil Liberties Union (ACLU) entitled War Comes Home: The Excessive Militarization of American
Policing.
The DLA website does not include a comprehensive list of where surplus military equipment winds up, but a spokesman for the agency told CNSNews.com that a database found on the Detroit Free Press website that lists military equipment distributed since 2006 was accurate because the data had previously been obtained from the DLA under the Freedom of Information Act.
A CNSNews.com review of the database found that some of the surplus items, such as binoculars and .45-caliber pistols, can easily transition to a civilian police setting.
But other equipment clearly intended for military use has also been sent to local law enforcement agencies. For example, in March, Wyoming’s Laramie County received an MRAP from the DLA. The Laramie County sheriff’s office told CNSNews.com that there have never been any recorded instances of landmines in the rural county, which has a population of just over 91,000.
Concerns over increased militarization of the police have prompted calls from both the left and the right for an end to the 1033 program.
“Militarization unfairly impacts people of color and undermines individual liberties, and it has been allowed to happen in the absence of any meaningful public discussion,” the ACLU report stated.
“Dressing police officers as soldiers is dangerous because the mindset of a soldier is entirely inappropriate for a police officer,” writes Tim Lynch of the Cato Institute. “Soldiers fight a military enemy; police officers deal with citizens, who are protected by the Bill of Rights.”
“If the Pentagon hands local cops millions of dollars’ worth of hammers, it should be no surprise when suddenly everything looks like a nail,” Lynch added.
But Crisp County, GA Sheriff Bill Hancock disagrees that the 1033 program should be scrapped, pointing out the benefits for small local law enforcement agencies like his.
Hancock told CNSNews.com that Crisp County also received a MRAP in February through the 1033 program, but that the sheriff’s office has removed the gun mount from the top and has not used it to date. He added that it would only be used in a hostage or shooting situation where officers’ lives could be in danger.
“It’s a good program,” Hancock told CNSNews.com. “You take that program away and somebody my size is not going to be able to equip all their SRT [Special Response Team] members with bulletproof vests. We’re not going to be able to equip them with night vision equipment. We’re not going to have some small handguns that we need because you’re gonna do away with the whole program.”

Terror in Boston: Hagel Says Pentagon Ready to Violate Posse Comitatus

During testimony on Capitol Hill, Chuck Hagel characterized the attack in Boston as terrorism and said the Pentagon is prepared to respond quickly to any request from domestic law enforcement, according to Pentagon’s propaganda newspaper, Stars and Stripes.
“(The attack) is clearly an act of terror and will be approached as an act of terror,” Hagel said.
“I will continue to consult closely with DOD senior leaders and my counterparts in other agencies,” Hagel added, “on how we can best support the government’s response and investigations.”
The event in Boston has provided the Department of Defense with a handy excuse to reverse the disestablishment of two National Guard civil support teams, including one currently responding to the bombing in Boston.
Over 400 Massachusetts National Guardsmen “remain on duty to continue to assist local authorities,” the newspaper reported, citing a press release from the Guard.

The 211th Military Police Battalion was deployed to provide security, the Massachusetts National Guard’s 387th Ordnance Company (Explosive Ordnance Disposal) has been activated, the 267th Combat Communications Squadron was sent to Boston, and the Navy sent a bomb-disposal unit “to assist local authorities as needed in the aftermath of the explosions.” In addition, the U.S. Northern Command on Monday decided not to change security levels at military installations in the U.S.
Under the Posse Comitatus Act passed on June 18, 1878, after the end of Reconstruction, the military is prohibited from involvement in such activity as the supply of support, training, intelligence and equipment to civilian law enforcement. Because the federalized National Guard is part of either the Air Force or the Army, it is covered by the Act, according to Seattle attorney Lynne Wilson.

Alastair's initial statements towards the Alabama news publication regarding the Boston Marathon training exercises
ignited a firestorm within the alternative media, despite being only around two sentences in length. Now, Alastair
has been given a forum to voice the entirety of what he saw as a participant and coach during the Boston Marathon —
something that Alastair says he has never seen before despite participating in much larger races around the
world.
As you can watch in the video above, Alastair detailed what went on before the race began:
"At the start at the event, at the Athlete's Village, there were people on the roof looking down onto the Village
at the start. There were dogs with their handlers going around sniffing for explosives, and we were told on a loud
announcement that we shouldn't be concerned and that it was just a drill. And maybe it was just a drill, but I've
never seen anything like that — not at any marathon that I've ever been to. You know, that just concerned me that
that's the only race that I've seen in my life where they had dogs sniffing for explosions, and that's the only
place where there had been explosions."
And Alastair is speaking from serious experience. As a veteran of marathons and a coach at the University of Mobile
in Alabama, Alastair knows about how marathons traditionally go down.
The interview with Alastair clarifies his former statements regarding the presence of bomb squads and bomb sniffing
dogs that went mega viral on the web, and also serves to better understand what the reality is behind this
situation. As Alastair details, there was definitely a drill taking place the morning of the marathon, and it
appears police were likely aware of a dangerous threat that required a large degree of action to counteract.

Pentagon Official Doesn't Know Why Local Police Need The Bayonets Feds Gave Them

WASHINGTON -- The Defense Department official who oversees the program that has sent billions of dollars' worth of military-style equipment to local police over the past several years couldn’t come up with a reason that cops on the streets need bayonets during a Senate hearing on Tuesday.
At a hearing examining the issue of police militarization, Sen. Rand Paul (R-Ky.) asked about an NPR investigation that found that nearly 12,000 bayonets had been sent to local police through the Law Enforcement Support Office (also known as the 1033 program) from 2006 through this year.
“What purpose are bayonets being given out for?” Paul asked Alan Estevez, who serves as principal deputy under secretary of defense for acquisition, technology and logistics.
“Bayonets are available under the program. I can’t answer what a local police force would need a bayonet for,” Estevez said.
“I can give you an answer: none,” Paul said.
Estevez said that the Defense Department does “not push any of this equipment on any police force,” and that the states decide what they need.
The hearing was called by Sen. Claire McCaskill (D-Mo.) in the wake of the aggressive police response to the protests that took place in Ferguson after the death of Michael Brown, an unarmed 18-year-old who was killed by a police officer in the St. Louis suburb.
